Virginia Federal Judge upholds Donald Trump’s ‘travel ban’ Executive Order

A Federal Judge in Virginia has upheld President Trump’s second ‘travel ban’  Executive Order, in a ruling which flatly contradicts rulings made previously by two other Federal Judges in Hawaii and Maryland.
This comes shortly after President Trump himself has said that he intends to fight for the Executive Order all the way up to the Supreme Court.

Judicial overreach? Hawaii Judge blocks new ‘travel ban’ Executive Order

In the last few hours a US Federal Judge in Hawaii, Judge Derrick Watson, has imposed a temporary restraining Order on President Trump’s second ‘travel ban’ Executive Order.
I do not yet have the transcript of Judge Watson’s decision.  However I understand that Judge Watson sought to use comments made by various persons associated with the administration – including possibly the President himself – to interpret the Order as discriminating against Muslims.

As the Trump administration had previously indicated that the President would do, Donald Trump today has issued a new ‘travel ban’ Executive Order replacing his previous ‘travel ban’ Executive Order, which has been the subject of legal proceedings.

The new Executive Order is a much lengthier document than its predecessor as it carefully responds to concerns raised by the previous Order’s critics and by the courts.

The US Federal Courts are the right place to decide the legality of Donald Trump’s ‘travel ban’ Executive Order

The legal moves and counter-moves in respect of Donald Trump’s ‘travel ban’ Executive Order – which includes the stay imposed on its enforcement by a Federal Judge on Friday – should be welcomed as in the present fraught atmosphere they are probably the only way of resolving the question of its legality.
