Apple Turns Down FBI Demand For Encryption Key Made Under 1789 Law, Defends 4th Amendment

Tim Cook, CEO of Apple, Inc. turned down the FBI’s demand using a 1789 federal ordinance to build a “backdoor” into iPhones allowing law enforcement to defeat encryption as he explained in a “Customer Letter” this morning posted to the company’s website.
Apple’s letter kicks off the highest profile defense of the U.S. Constitution’s Fourth Amendment we are likely to see in our lifetimes.

Ohio Man Sentenced to 240 Days for Recording Cops and Holding Up Sign Warning Drivers of DUI Checkpoint

An Ohio man was sentenced to 240 days in jail Thursday for First Amendment-related activities, including attempting to video record police in public and warning drivers of an upcoming DUI checkpoint by holding up a sign.
Douglas “Deo” Odolecki of Cleveland Cop Block was whisked away to jail immediately after the trial.
His attorney, John Gold, plans to appeal.
“The judge far exceeded her authority today,” he said in a telephone interview with Photography is Not a Crime.

FBI Surround Malheur Refuge as Nevada Assemblywoman Seeks Peaceful Resolution (Live Stream)

FBI Agents are surrounding the four remaining occupants of the Malheur National Wildlife Refuge in an ongoing situation that is being live streamed by activist Gavin Seim, who is on the phone with them.
The situation sound tense with the occupants saying they will not surrender.
Seim connected them with Nevada assemblywoman Michele Fiore, who said she has landed in Portland, and is trying to resolve the situation nonviolently.

Maryland Cop Orders Pizza Delivery Man Out at Gunpoint for Not Pulling Over Quick Enough (Updated)

A video surfaced Monday showing a high-strung, agitated and paranoid police officer threatening a pizza delivery man out of his car at gunpoint as the man video records with his phone.
“Can you put your gun away, please, sir,” the driver asks as he records.
“Put your hands on the steering wheel,” the cop orders.
The cop has been identified as being from Maryland but not many other details are available at this time, including when the incident took place.

U.S. Marshals Crash Van into Woman’s Car in Puerto Rico, then Pull Gun on Woman for Recording Them Before Driving Off

Two U.S. Marshals are coming under fire after slamming their van into a woman’s car, pointing a gun at her and then, after realizing she was recording them, taking off like nothing ever happened, proving they are held to even lesser standards in Puerto Rico.
Raquel Vélez, who recorded the video, says to make matters worse, the incident took place in front of a federal prison. She wasted no time in reporting the U.S. Marshals (one of them apparently is known as “Agent Rivera”) and highlighted how she could not believe they pointed a firearm at her when she had done nothing wrong.

Florida School Board Violated Open Meetings Sunshine Law to Sue PINAC’s Jeff Gray

A Florida School Board and its lawyer announced that they’ve violated the state’s constitution’s “Sunshine Law” requiring open meetings, by making the decision to file a SLAPP lawsuit against PINAC’s Jeff Gray for reporting about school bus safety violations.
The St. Johns County School District swore in court documents that filed suit without a public hearing or notice, and it’s attorney admitted publicly this week polling elected school board officials in advance of any possible hearing.

Chicago Cop Plans on Suing Estate of Teen He Killed Because He was Left with Emotional Distress

The Chicago police officer who shot and killed a teenager wielding a baseball bat along with an innocent bystander last month plans to sue the teen’s estate because of the emotional distress he has suffered since killing them both.
Robert Rialmo, who has been on the force for three years, said he was in fear for his life when he killed Quintonio LeGrier the day after Christmas.

Arizona Senator Withdraws Bill That Would Have Criminalized the Recording of Cops

The Arizona senator who was trying to pass a law that would have made it illegal to record police from within 20 feet withdrew his bill after a national backlash that anybody could have predicted.
Anybody except John Kavanagh, the retired cop turned republican legislator who failed to do his research before proposing such a preposterous law.
