A Milwaukee cop arrested for raping two men in October was charged with homicide today in the shooting death of another man during the summer, which sparked two days of riots and protests in the Wisconsin city.
Dominique Heaggan-Brown, who was fired after the sexual assault arrest, was charged with first-degree reckless homicide for shooting and killing Sylville Smith on August 13.
The shooting was captured on Heaggan-Brown’s body camera, which is what led to the charges.
Also captured on video were the sexual assaults, which is what led to that arrest.
None of the videos have been been released, but prosecutors saw a different chain of events from the shooting than initially described by Milwaukee Police Chief Edward Flynn, who claimed the video showed Smith turning towards the officer with a gun in his hand, making him fear for his life.
According to USA Today:
The criminal complaint says Heaggan-Brown’s first shot hit Smith in the arm while Smith was throwing a gun over a fence.
The second shot, which hit Smith in the chest, was fired after Smith tossed the gun and fell to the ground with his hands near his head.
The criminal complaint details what investigators saw on body-camera footage:
Heaggan-Brown and another officer ran after Smith. Smith slipped to the ground before standing with a gun in his hand and turning his upper body toward the officers. Smith then threw the gun over a fence into a nearby yard as the first shot was fired.
According to preliminary information provided by city officials, Smith, 23, was shot when he ran from a traffic stop Aug. 13. Police Chief Edward Flynn has said body camera footage shows Smith was armed and turning toward Heaggan-Brown, 24, who then opened fire.
One day after the shooting, Heaggan-Brown was sitting in a bar when news of the shooting came on the television.
He then began to brag about the shooting to another man sitting at the bar, telling the man he could do whatever he wanted.
Later that night, he raped the man in his bedroom after the man claimed he resisted his advances but blacked out as the cop penetrated him anally.
The man contacted police, who searched Heaggan-Brown’s phone and found evidence of the rape as well as evidence of him raping another man and propositioning other men while on duty.
