Rhodes never entered the Capitol. Rhodes' attorney said that the Oath Keeper and his co-defendants did engage in a lot of "horribly heated rhetoric and bombast." But he told jurors that their “venting” was not a crime. The case is being used to smear Trump ahead of the 2024 election.

Defense lawyers for the Oath Keepers said in September, “What the Government knew — but only recently disclosed to the Defendants — was that none of the confidential human sources provided evidence of guilt on the part of the Oath Keepers as an organization, or the individual Defendants in this case.”
