The governors, prime ministers, premiers, chief ministers, and administrators of sub-national governments have been almost unanimous in decrying the lack of support from central governments during the current Covid-19 crisis. Not least among these have been the governors of the American states of New York, Michigan, Washington, and other states and U.S. territories.

Racine County Sheriff Christopher Schmaling says he will not enforce shutdown and shat-at-home orders because state law “does not have the power to supersede or suspend the Constitutional rights of American citizens.”

Judge Justin Walker wrote,“On Holy Thursday, an American mayor criminalized the communal celebration of Easter." He said: “The Mayor’s decision is stunning. And it is, ‘beyond all reason,’ unconstitutional.”

Worshipers arrived despite police warning they would record their car plates to force them into 14-day quarantines. The church’s pastor, Reverend Roberts, maintained he has a constitutional right to hold services for his faithful.

This has been the pattern: the Executive assumes new power that is never fully annulled when the threat ends.
